Doing drugs is illegal. Last check, it's about 2/3 of the dealing penalty. (i.e. 15 years dealing class A, 10 years posession).

Secondly, while downloading is illegal, most companies don't wish to launch expensive lawsuits until you've downloaded enough that they'll actually gain something.
